Article 3: Confidentiality of access
The collection of information concerning the Customer, requested in the contact forms, is necessary for the processing of Customer requests, the sending of information on our products, and for statistical management analyses. To ensure data security, it is the Customer's responsibility to keep his/her password and username secret. GE Lab SAS informs the Customer that his/her data is recorded, in accordance with the provisions of law no. 78-17 of January 6, 1978, for the purposes of customer relations management. Consequently, the Customer has the right to access, modify, rectify or delete the data collected by contacting GE Lab as indicated in Article 14. The data transmitted by the Customer is kept for the legal time required to provide evidence. GE Lab is prohibited from disclosing or reselling any nominative data relating to the Customer, subject to any provisions to the contrary in the special conditions and in particular the Customer's agreement to receive advertising from GE Lab and the communication of the value of his/her order on an anonymous basis to Google Analytics© for statistical purposes. If you leave a comment, the comment and its metadata are stored indefinitely. This makes it possible to automatically recognize and approve subsequent comments instead of leaving them in the moderation queue. For users who register on our site, we also store the personal data indicated in their profile. You can request a file containing all the personal data we hold about you, including that which you have supplied to us. You can also request the deletion of your personal data. This does not include data stored for administrative, legal or security purposes.
Article 4: Ordering
Customers can place orders on the https://nobilis-product.fr website. The ordering process is as follows: a) choose the items and add them to the basket. The customer is informed in real time of the availability of the product(s) they wish to order b) validation of the contents of the basket c) identification on the https://nobilis-product.fr website if the customer is not already identified d) choice of delivery method. The customer is informed of the cost of shipping and the delivery time e) choice of payment method and acceptance of the GCS f) confirmation of payment. Product offers are subject to availability and GE Lab makes no commitment of any kind.
To place an order, the Customer must first register on the Site by choosing a login and password. The Customer must check the completeness and accuracy of the information provided at the time of ordering, in particular concerning the delivery address, billing address, bank details and information. GE Lab cannot be held responsible for any input errors and their consequences (e.g. delays or delivery errors). In such cases, the Customer will be responsible for any costs incurred in re-sending the order.
The customer confirms his/her order using the electronic purchasing procedure on the Site. This confirmation by the customer establishes the sales contract between the Site customer and the seller of the product. The sale will only be firm and definitive, and availability and shipment times will only begin, once GE Lab has sent the Customer confirmation of acceptance of the order by e-mail. This confirmation is only sent by GE Lab once it has received the purchase order and the definitive receipt (as stated in the "Payment" article) of the sums due by the Customer. GE Lab reserves the right to refuse or cancel any order or delivery from a Customer with whom there is a dispute over payment of a previous order. The Customer can follow the progress of his order on the Site, in the "My Account" section.

Article 5: Right of withdrawal
In accordance with the law, the customer has a cooling-off period of 14 clear days from delivery of the products to return them to GE Lab for exchange or reimbursement. The product must be unopened before being returned. The Customer must inform GE Lab of his/her wish to exercise this right of withdrawal by registered mail or e-mail sent to the following address: nobilis.product@gmail.com. The Customer must return the product to GE Lab's address. The cost of returning the product will be borne exclusively by the Customer. The sums paid by the Customer at the time of ordering, including the initial delivery charges, will be reimbursed in full by credit to the Customer's credit card or by bank transfer within a maximum period of 14 days from the exercise of the right of withdrawal. In the event of late reimbursement, the reimbursement will be increased by 10% for 30 days' delay, 20% for 60 days' delay and 50% thereafter. The Customer may, at GE Lab's discretion, opt for another method of reimbursement, in particular in the form of credit notes or vouchers.
Article 6: Product prices and payment
Prices are given in Euros (€) inclusive of all taxes, excluding delivery charges. Shipping costs can be consulted on the Site at any time in the "delivery" section. Prices are valid in metropolitan France and in member countries of the European Union. All prices are on an INCOTERMS "Delivery At Place" (DAP) basis. Any customs duties that may be due are to be paid by the Customer directly to the delivery agent. GE Lab collects the price inclusive of delivery charges.
GE Lab reserves the right to modify its prices at any time. Products are invoiced on the basis of the prices in force on the day GE Lab confirms acceptance of the order. The price indicated in GE Lab's confirmation of the order is the final price, except for VAT, the rate applied being that in force on the day of delivery of the products. These prices are firm and non-revisable except for promotions organized by the Site. If a price reduction is announced on the Site, the reference price will be indicated.
The price is payable either in full on the day the order is placed by the Customer a) by credit card (Visa, Mastercard, Carte Bleue, American Express) online or b) by bank transfer. In the case of cash payment, products are dispatched within a maximum of 48 hours on working days. In the case of payment by cheque or bank transfer, products are dispatched within 48 hours of receipt of payment to the address indicated at the bottom of the GTCS.

GE Lab will not be obliged to deliver the products ordered by the Customer unless the price and delivery charges have been paid in full. Payments made by the Customer will only be considered final after payment has been made into our bank account. Payments are to be made net and without discount. Unless expressly agreed otherwise in advance and in writing by the seller, and provided that reciprocal receivables and debts are certain, liquid and due, no compensation may be validly made between any penalties for late delivery or non-conformity of the products with the order and the sums due in respect of the purchase of the products from the seller.
As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification.
Article 7: Availability
The products listed on the Site fall into two categories:
- a) Products in stock on GE Lab's premises, which the Customer may add to the basket and order. These products are clearly indicated as "in stock" on the pages listing the Site's assortment and on the detailed product description sheets.
- b) Products currently being restocked, which the Customer cannot add to the basket or order, but whose detailed description sheets can be consulted. These products are clearly indicated as "out of stock" in the detailed product description sheets. The customer can ask to be informed as soon as these products are put back on sale once they have been restocked, by contacting customer service by e-mail.
However, an error may exceptionally occur. In this case, and in the absence of availability of one or more items ordered, GE Lab undertakes to inform the Customer as soon as possible, and to offer a replacement product where possible. The Customer will then have the option of accepting the replacement product (within the time limit specified in the replacement offer), or requesting cancellation of the order in its entirety. In the event of cancellation of an order, the Customer will be reimbursed:
- if payment has been made by credit card or bank transfer, as soon as possible and within 10 days at the latest, by crediting your bank account;
Article 8: Delivery
8.1 Shipping terms :
Packages are delivered to the address indicated by the Customer on the order form. In the event of a specific request from the Customer concerning the packaging or transport conditions of the products ordered, duly accepted in writing by GE Lab, the related costs will be subject to specific additional invoicing, based on a quotation previously accepted in writing by the Customer. In the absence of a specific request from the Customer, packaging and shipping will be in accordance with the standard established by GE Lab. GE Lab declines all responsibility in the event of excessive delivery delays due to postal services (strikes or malfunctions).
The following delivery methods are available in France:
- a) - at home
- Colissimo "Access": delivery directly to the letterbox without a signature or by any other method agreed between La Poste and the Customer. La Poste may initiate door-to-door delivery to any person present at the address. Failing this, and if it is impossible to deliver to a letterbox, La Poste may deliver to a neighbor, janitor or concierge who agrees to take delivery. This person's contact details will be indicated to the recipient on a notice delivered to the letterbox at the delivery address indicated by the Customer. The absence of a letterbox, or of personal details on the letterbox, or its inaccessibility, discharges GE Lab and La Poste from its obligation to deliver to the address indicated by the Customer. If the size of the parcel exceeds that of the letterbox, and/or in the absence of a neighbor, janitor or concierge, a notice of pending delivery will be sent indicating the address of the post office where the parcel can be collected, or the parcel will be presented again at a later date, on the initiative of La Poste. Delivery of any item held at the counter to the addressee or his duly authorized representative on presentation of proof of identity and against signature, with a maximum holding period of 15 consecutive days (excluding the day of presentation at home). - b) away from home (currently unavailable)
- Mondial Relay: delivery to the Point Relais® selected by the customer. Notification by email or SMS as soon as the parcel is available in the Point Relais®. The parcel must be collected within 15 days of being made available at the Point Relais®. After this period, the parcel is returned to the sender and any new delivery will be at the Customer's expense. Very light and/or very small packages may be sent by priority mail to the Customer's home address instead of the chosen Point Relais®, at GE Lab's discretion. In this case, the Customer will be notified by e-mail at the time of dispatch.
8.2 Deadlines :
Average delivery times from GE Lab's premises to mainland France excluding Corsica are as follows:
- Mondial Relay: 3 to 5 days, Tuesday to Saturday
- GLOS: 48 to 72 hours, Monday to Saturday
Except in special cases or when one or more products are unavailable, products ordered will be delivered in a single shipment. These delivery times are given for information only. In the event that the planned delivery date for products is exceeded by more than seven days and is not due to force majeure or fault on the part of the Customer, the Customer may request that the sale be rescinded in accordance with article L. 114-1 of the French Consumer Code, and obtain a refund of any sums paid in connection with the sale if delivery has not taken place between the sending and receipt of this letter of rescission. The Customer has sixty working days from the date indicated for delivery of the goods to exercise this right. GE Lab cannot be held responsible for the consequences of late delivery, and no compensation can be claimed for late delivery of products.
8.3 Conformity :
In all cases, the customer is obliged to check the condition of the packaging and the contents of the goods on delivery, in the presence of the La Poste employee, the delivery person or the Point Relais® or Relais Chrono® manager. In the event that the Customer has any doubt whatsoever as to the condition or contents of the parcel a) he/she is required to follow the procedure specific to each carrier, and if necessary, to refuse the goods by immediately issuing an anomaly report (report 170 in the case of La Poste) b) to report such incidents to GE Lab by e-mail nobilis.product@gmail.com.
The customer is obliged to check the condition of the products delivered and their conformity with the order. The customer has 48 hours from the date of delivery to send a registered letter with acknowledgement of receipt to express any reservations or claims for non-conformity or apparent defects of the products delivered, together with all relevant proof. This notification of reservations will enable the carrier to be held liable. Once this period has elapsed and if these formalities have not been complied with, the products will be deemed to be in conformity and free of any apparent defect, and no claim will be validly accepted by GE Lab. GE Lab will replace, as soon as possible and at its own expense, any delivered products for which the Customer has duly proven the apparent defects or lack of conformity. The products sold on the Site comply with the regulations in force in France. GE Lab cannot be held responsible for non-compliance with the legislation of the country to which the products are delivered, which it is the Customer's responsibility to check. Please note that if the Customer entrusts a third party with the delivery of the product (concierge in your building, receptionist in the workplace, etc.), the third party receives the parcel in the name and on behalf of the Customer. The customer must therefore ask the third party to be vigilant in following the usual precautions, and remind them to treat the item received with the same care as if they were personally the recipient. Only in the specific case of non-conforming delivery will GE Lab assume the cost of return or reimburse the Customer.
It is the customer's responsibility to take all necessary steps (insurance, tracking, etc.) to ensure that the product is returned directly to GE Lab in its original condition. In any case, these precautions do not prevent the customer from benefiting from legal guarantees, in particular those relating to hidden defects, or from exercising the right of retraction.
Article 9: Limitation of liability
GE Lab shall not be held liable for any direct or indirect damage of any kind (loss of profit, etc.) resulting from the malfunction or misuse of the products sold. GE Lab's liability shall in any event be limited to the amount of the order and shall not be held liable for simple errors or omissions that may have occurred despite all the precautions taken in the presentation of the products. The photographs and illustrations accompanying the products on the Site, as well as the indication of their weight, do not have any contractual value and cannot engage the responsibility of GE Lab. In the event of a force majeure event, in accordance with Article 1148 of the French Civil Code, GE Lab shall not be held liable for any delay in processing a Customer file or for breach of contract.
Article 10: Reservation of ownership
Products ordered on the Site remain the property of GE Lab until final receipt of payment, plus delivery charges. As long as the seller's right of ownership exists, no sale, pledging, rental or other making available, incorporation or transformation of the products may take place without the prior written authorization of GE Lab, which may make its authorization subject to the provision of a payment guarantee or require that the resale price be allocated to it. The Customer hereby authorizes GE Lab and its carrier to enter the premises where the products are located during working hours in order to collect the products.
Article 11: Cookies
The Site uses cookies. A cookie is a computer file installed on the hard disk of the customer's personal computer. Cookies enable Green Media 21 SAS to identify customers accessing its site, and thus to offer them services best suited to their needs. Customers can configure their Internet browser to block the activation of cookies. In this case, the customer will not be able to view the services offered (for example, he/she will have to identify himself/herself each time an order is placed). The Customer may also manually delete cookies at any time.
Article 12: Applicable law and language
By express agreement between the parties, the present contract is governed by and subject to French law. It is written in French. Should it be translated into one or more languages, only the French text will be deemed authentic in the event of a dispute.
Article 13: Disputes
All disputes arising from the present contract, concerning its validity, interpretation, performance, termination, consequences and follow-up, will be submitted to the competent courts under the conditions of common law. In the event of a dispute with professionals and/or merchants, the courts of Besançon (France) shall have jurisdiction.

All notifications, communications and formal notices provided for in the GCS shall be deemed to have been validly delivered if sent by registered letter with acknowledgement of receipt:
- For GE Lab: at the above address
- For the Customer: at the postal and/or e-mail address provided to GE Lab, under the Customer's sole responsibility. GE Lab must be notified of any change of address.
