Article 3: Confidentiality of access
The collection of information about the Customer, as requested in the contact forms, is necessary for processing Customer requests, sending information about our products, and conducting statistical analyses for management purposes. To ensure data security, it is the Customer’s responsibility to keep their password and username confidential. CANNAWYSS SA informs the Customer that their data is recorded, in accordance with the provisions of Law No. 78-17 of January 6, 1978, for the purposes of customer relationship management. Consequently, the Customer has the right to access, modify, correct, or delete their collected data by contacting CANNAWYSS SA as indicated in Article 14. Data provided by the Customer is retained for the legally required period necessary for the presentation of evidence. CANNAWYSS SA shall not disclose or resell any personally identifiable information relating to the Customer, subject to any contrary provisions in the Special Terms and Conditions, including the Customer’s consent to receive advertisements from CANNAWYSS SA and the anonymous reporting of the order value to Google Analytics© for statistical purposes. If you leave a comment, the comment and its metadata are retained indefinitely. This allows us to automatically recognize and approve subsequent comments instead of holding them in the moderation queue. For users who register on our site, we also store the personal data provided in their profile. You may request a file containing all the personal data we hold about you, including the data you have provided to us. You may also request the deletion of your personal data. This does not apply to data stored for administrative, legal, or security purposes.
Article 4: Ordering
The Customer may place an order on the websitehttps://nobilis-product.fr. The ordering process is as follows: a) Select items and add them to the shopping cart. The Customer is notified in real time of the availability of the product(s) they wish to order. b) Review and confirm the contents of the shopping cart. c) Log in to the websitehttps://nobilis-product.frif the Customer is not already logged in. d) Select a shipping method. The Customer is informed of the shipping cost and delivery time. e) Select a payment method and accept the Terms and Conditions. f) Confirm payment. Product offers are subject to availability and do not constitute a specific commitment on the part of CANNAWYSS SA.
To place an order, the Customer must first register on the Website by choosing a username and password. The Customer must verify that the information provided when placing the order is complete and accurate, particularly with regard to the shipping address, billing address, contact information, and banking details. CANNAWYSS SA cannot be held liable for any data entry errors or the resulting consequences (such as delays or delivery errors). In such cases, the costs incurred for reshipping the order would be borne by the Customer.
The Customer confirms their order through the online checkout process on the Website. This confirmation by the Customer establishes the sales contract between the Website’s Customer and the product’s seller. The sale will not be binding and final, and the availability and shipping timeframes will not begin until CANNAWYSS SA has sent the Customer an email confirming acceptance of the order. CANNAWYSS SA will send this confirmation only after it has received the order form and the final payment (as described in the “Payment” section) of the amounts owed by the Customer. CANNAWYSS SA reserves the right to refuse or cancel any order or delivery to a Customer with whom there is a dispute regarding payment for a previous order. The Customer may track the status of their order on the Website under the “My Account” section.

Article 5: Right of withdrawal
In accordance with the law, the Customer has a 14-day withdrawal period, starting from the date of delivery of the products, to return them to CANNAWYSS SA for an exchange or refund. To do so, the product must not have been opened before being returned. The Customer must notify CANNAWYSS SA of their intention to exercise this right of withdrawal by registered mail or email sent to the following address: nobilis.product@gmail.com. The Customer must return the product to CANNAWYSS SA’s address. Return shipping costs shall be borne exclusively by the Customer. The amounts paid by the Customer at the time of order, including the initial shipping costs, will be refunded in full via credit to the credit card or bank transfer within a maximum of 14 days from the date the right of withdrawal is exercised. In the event of a delayed refund, the refund amount will be increased by 10% for a 30-day delay, 20% for a 60-day delay, and 50% thereafter. The Customer may, if they wish, opt—upon CANNAWYSS SA’s proposal—for an alternative refund method, such as store credit or gift cards. Administrative fees may apply in the event of a refund.
Article 6: Product prices and payment
Prices are listed in Euros (€), all taxes included, excluding shipping costs. Shipping costs can be viewed on the Website at any time under the “Delivery” section. Prices are valid in mainland France and in European Union member countries. All prices are based on the INCOTERMS “Delivery At Place” (DAP) term. Any customs duties that may be due are the responsibility of the Customer, who must pay them directly to the delivery agent. CANNAWYSS SA collects the price, including all taxes and shipping costs.
CANNAWYSS SA reserves the right to change its prices at any time. Products are billed based on the rates in effect on the date CANNAWYSS SA confirms acceptance of the order. The price indicated in the order confirmation from CANNAWYSS SA is the final price, excluding VAT, with the applicable rate being that in effect on the date of delivery of the products. These prices are firm and non-negotiable, except for promotions organized by the Site. If a price reduction is announced on the Site, the original price will be indicated.
The price is payable either in full on the day the order is placed by the Customer a) by credit card (Visa, Mastercard, Carte Bleue, American Express) online or b) by bank transfer. In the case of cash payment, products are dispatched within a maximum of 48 hours on working days. In the case of payment by cheque or bank transfer, products are dispatched within 48 hours of receipt of payment to the address indicated at the bottom of the GTCS.
CANNAWYSS SA shall not be required to deliver the products ordered by the Customer if the price and shipping costs have not been paid in full in advance. Payments made by the Customer shall not be considered final until the funds have been credited to our bank account. Payments are due net and without discount. Unless expressly agreed in advance and in writing by the seller, and provided that the reciprocal claims and debts are certain, liquid, and due, no set-off may validly be made between any penalties for late delivery or non-conformity of the products with the order and the amounts due for the purchase of the products from the seller.
As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification.
Article 7: Availability
The products listed on the Site fall into two categories:
- a) Products in stock at CANNAWYSS SA’s facilities, which the Customer may add to the shopping cart and order. These products are clearly marked as “in stock” on the pages listing the Site’s product selection and in the detailed product descriptions.
- b) Products currently being restocked, which the Customer cannot add to the basket or order, but whose detailed description sheets can be consulted. These products are clearly indicated as "out of stock" in the detailed product description sheets. The customer can ask to be informed as soon as these products are put back on sale once they have been restocked, by contacting customer service by e-mail.
However, errors may occur in exceptional cases. In such cases, if one or more of the ordered items are unavailable, CANNAWYSS SA agrees to notify the Customer as soon as possible and to offer a replacement product whenever possible. The Customer will then have the option to accept the replacement product (within the time frame specified in the replacement offer) or request that the entire order be canceled. In the event of an order cancellation, the Customer will be refunded:
- if payment has been made by credit card or bank transfer, as soon as possible and within 10 days at the latest, by crediting your bank account;
Article 8: Delivery
8.1 Shipping terms :
Packages are delivered to the address specified by the Customer on the order form. In the event of a specific request by the Customer regarding the packaging or shipping conditions for the ordered products, which has been duly accepted in writing by CANNAWYSS SA, the associated costs will be subject to a separate, additional invoice based on a quote previously accepted in writing by the Customer. In the absence of a specific request from the Customer, packaging and shipping will follow the standard procedures established by CANNAWYSS SA. CANNAWYSS SA assumes no liability for excessive delivery delays caused by postal services (strikes or disruptions).
The following delivery methods are available in France:
- a) - at home
- Colissimo “Access”: Delivery directly to the mailbox without a signature, or via any other method of delivery agreed upon between La Poste and the Customer. La Poste may deliver the package to the doorstep to any person present at the address. If this is not possible and delivery to the mailbox is not feasible, La Poste may deliver the package to a neighbor, building manager, or doorman who agrees to accept it. The recipient will be provided with the contact information for the person who accepted the package via a delivery notice placed in the mailbox at the delivery address specified by the Customer. The absence of a mailbox, the lack of a name on the mailbox, or the inaccessibility of the mailbox releases CANNAWYSS SA and La Poste from their obligation to deliver to the address specified by the Customer. If the package is too large to fit in the mailbox and/or no neighbor, building manager, or doorman is present, a hold notice will be left indicating the contact information for the post office where the package can be picked up, or the package will be presented again at a later date at the initiative of La Poste. Any item held at the counter will be handed over to the recipient or their duly authorized representative upon presentation of identification and against a signature, with a maximum holding period of 15 consecutive days (excluding the day of the initial delivery attempt). After this period, the package will be returned to the sender. - b) away from home (currently unavailable)
- Mondial Relay: Delivery to the Point Relais® selected by the Customer. Notification via email or text message as soon as the package is available at the Point Relais®. The package must be picked up within 15 days of becoming available at the Point Relais®. After this period, the package is returned to the sender, and any subsequent delivery will be at the Customer’s expense. Very light and/or very small packages may be sent by La Poste as priority mail to the Customer’s home address instead of the selected Point Relais, at the discretion of CANNAWYSS SA. In this case, the Customer will be notified by email upon shipment.
8.2 Deadlines :
The average delivery times from CANNAWYSS SA's facilities to mainland France (excluding Corsica) are as follows:
- Mondial Relay: 3 to 5 days, Tuesday to Saturday
- GLOS: 48 to 72 hours, Monday to Saturday
Unless there are special circumstances or one or more products are unavailable, the ordered products will be delivered in a single shipment. These delivery times are provided for informational purposes only. If the expected delivery date for the products is exceeded by more than seven days and this delay is not due to force majeure or the Customer’s fault, the Customer may request cancellation of the sale under the terms set forth in Article L. 114-1 of the French Consumer Code and obtain a refund of the amounts paid for the sale if delivery has not occurred between the mailing and receipt of this cancellation notice. The Customer has sixty business days from the date specified for delivery of the goods to exercise this right. CANNAWYSS SA shall not be held liable for any consequences resulting from a delay in delivery, and no compensation may be claimed from it on this basis for a delay in the delivery of products.
8.3 Conformity :
In all cases, the Customer is required to verify, in the presence of the La Poste representative, the delivery person, or the Point Relais® or Relais Chrono® manager, the condition of the package and its contents upon delivery. If the Customer has any doubts whatsoever regarding the condition or contents of the package, a) they must follow the procedure specific to each carrier and, if necessary, refuse the goods by immediately filing a damage report (Form 170 in the case of La Poste); b) report these incidents to CANNAWYSS SA by email at nobilis.product@gmail.com
The Customer is required to verify the condition of the delivered products and their conformity with the order. The Customer has 48 hours from the time of delivery to submit, by certified letter with acknowledgment of receipt, any reservations or claims regarding non-conformity or apparent defects in the delivered products, along with all supporting documentation. This notification of reservation will establish the carrier’s liability. After this period has elapsed, and if these formalities have not been followed, the products will be deemed to be in compliance and free from any apparent defects, and no claim may be validly accepted by CANNAWYSS SA. CANNAWYSS SA will replace, as soon as possible and at its own expense, any delivered products for which apparent defects or non-conformities have been duly proven by the Customer. The products sold on the Website comply with current regulations in France. CANNAWYSS SA shall not be held liable in the event of non-compliance with the laws of the country to which the products are delivered; it is the Customer’s responsibility to verify such compliance. Please note: if the Customer authorizes a third party to receive the product (e.g., your building’s concierge, a receptionist at your workplace, etc.), that third party receives the package in the Customer’s name and on the Customer’s behalf. The Customer must therefore ask that person to be vigilant in following standard precautions and remind them to treat the received item with the same care as if they were the personal recipient. Only in the specific case of a non-compliant delivery will return shipping costs be covered by CANNAWYSS SA or reimbursed to the Customer.
The Customer is responsible for the return: it is the Customer’s responsibility to take all necessary steps (insurance, tracking, etc.) to ensure that the product is returned in its original condition directly to CANNAWYSS SA. In any event, these precautions do not preclude the Customer from benefiting from statutory warranties, particularly those relating to hidden defects, or from exercising the right of withdrawal.
Article 9: Limitation of liability
CANNAWYSS SA shall not be held liable for damages of any kind, whether direct or indirect (including loss of profits, etc.), resulting from the malfunction or misuse of the products sold. CANNAWYSS SA’s liability shall in any event be limited to the amount of the order and cannot be invoked for simple errors or omissions that may have remained despite all precautions taken in the presentation of the products. The photographs and illustrations accompanying the products on the Website, as well as the approximate weight indicated, are not contractually binding and therefore do not give rise to any liability on the part of CANNAWYSS SA. In the event of a force majeure, in accordance with Article 1148 of the Civil Code, CANNAWYSS SA shall not be held liable for any delay in processing a Customer’s order or for any failure to perform the contract.
Article 10: Reservation of ownership
Products ordered on the Site remain the property of CANNAWYSS SA until payment, including shipping costs, has been fully received. As long as the seller retains ownership, no sale, pledge, lease, or other transfer, incorporation, or alteration of the products may take place without the prior written authorization of CANNAWYSS SA, which may make its authorization contingent upon the provision of a payment guarantee or require that the resale price be paid to it. The Customer hereby authorizes CANNAWYSS SA and its carrier to enter, during business hours, the premises where the products are located to remove them.
Article 11: Cookies
The Site uses cookies. A cookie is a computer file installed on the hard disk of the customer's personal computer. Cookies enable Green Media 21 SAS to identify customers accessing its site, and thus to offer them services best suited to their needs. Customers can configure their Internet browser to block the activation of cookies. In this case, the customer will not be able to view the services offered (for example, he/she will have to identify himself/herself each time an order is placed). The Customer may also manually delete cookies at any time.
Article 12: Applicable law and language
By express agreement between the parties, the present contract is governed by and subject to French law. It is written in French. Should it be translated into one or more languages, only the French text will be deemed authentic in the event of a dispute.
Article 13: Disputes
All disputes arising from the present contract, concerning its validity, interpretation, performance, termination, consequences and follow-up, will be submitted to the competent courts under the conditions of common law. In the event of a dispute with professionals and/or merchants, the courts of Besançon (France) shall have jurisdiction.
